How Often Do Cases Go to Trial?

The cases that actually end with a judge and jury ruling on the case are less than 1%. More often than not a compromise will be met and a resolution will be reached.

From the claims perspective, there will be a few things going on. First we tend to see a covered claim in which you aren’t in the wrong. Standard liability policies for businesses will not cover any sort of contractual dispute at all. It may cover bodily injury or property damage resulting from a contractual dispute, but the dispute itself will not be covered.
