How do insurance companies define Florida Landscaper Insurance?

Landscape contractors design, install, and maintain the exterior land or plot finish. This can include not only the installation of sod for a lawn or grass foundation, but also the placement of trees, bushes, shrubs, flowers, and other plants. Some landscape contractors will change the contours of the grounds, while other will limit their work to planting or maintaining lawns and plants. Some landscapers install or winterize underground sprinkler systems. Others will provide a lawn or grounds maintenance service. Additional operations may include nurseries or lawn and garden shops. What risk exposure do Landscape Contractors have?

Property Exposures
Can be simple office and vehicle or equipment storage; others may operate a complete nursery. Whenever vehicles are maintained or repaired within buildings, fire potential increases.

Other property exposures unique to this type of operation may be the use or sale of live and growing plants, shrubs, bushes, trees, or flowers. These may grow in a yard, or in an enclosure such as a greenhouse. If either exposure exists, loss from wind, hail, frost, or other natural elements needs to be carefully evaluated. Specialty coverages designed specifically for loss to growing plants by weather phenomena may be needed.

Greenhouses present unique exposures to loss. Older structures of glass may be subject to frequent glass breakage losses. Newer structures are simply frames with plastic coverings. These plastic coverings need frequent replacement as they tend to yellow or cloud in the weather and block out the necessary sunlight.

Fire hazards can be high from the flammables used in the repair of vehicles or equipment, such as solvents and degreasers, as well as the chemicals in fertilizers and insecticides. If these exposures are more than incidental, the failure of the landscape contractor to store them properly (in appropriate containers with proper separation) may indicate a morale hazard.

Inland Marine Exposures
Always includes contractors’ equipment used to care for lawns, trees and shrubs. This type of equipment may include mowers, sprayers and even cherry pickers for tree trimming and trenchers for underground work. Inland marine may also include unique exposures related to the transporting of live plants, trees and shrubs to the customer’s property. The transport exposure is based on whether trees are transported, and if so, the size of the trees. While most landscapers will only use young trees, some transport mature trees. This is a very difficult move and requires specialized equipment for both removal and transport.

Premises Liability Exposures
Hazards arise from installation, service, and attractive nuisance at the job site. Installation or service work hazards include injury or damage from stones or other debris thrown by power mowers, trimmers, and other equipment. Tree trimming may result in falling branches or debris that causes injury or damages power lines or other property. Trenching or grading may cause damage to underground lines. Observers of the landscaping activities can be injured due to flying debris from mowing and tree trimming. .A major concern is the application of lawn chemicals, which represents both a premises and completed operations hazard that could result in serious long-term injury, illness, or disease to customers and passersby. Less seriously, overspray from operations could result in small but frequent property damage losses. Contractors who do not obtain and keep proper licensing and certification for chemical applications create a serious liability exposure to themselves.

Environmental Impairment
Has significant concerns. Any type of chemicals will result in significant disposal and waste treatment hazards. Lack of awareness of, and compliance with, all EPA and local standards is of significant concern. Employees who handle chemicals must have the appropriate licenses and certifications individually.

Automobile Exposures
Can be very limited if the service is maintenance only and does not supply plants. If plants and large trees are transported the exposure increases. Some may be oversized transport and all consideration must be taken to avoid damage to property during the transport.

Workers Compensation
Come from the operation of machinery and equipment, including some work at heights, work on uneven ground, and exposure to underground or above ground cables and lines. Since power-cutting equipment is used, there are also potential cuts and possible amputations. Back injuries, hernias, sprains, and strains are all common claims. Chemical applications may cause lung problems along with allergic reactions and other more serious complication. Casual labor, seasonal workforce, and high turnover present a significant loss control challenge.

I work for a lawn service company. Does my employer have to carry workmans comp for me?

The requirement to purchase workers compensation coverage in Florida depends on several factors. One of them is the type of operations being performed by employees (e.g. mowing the lawn is considered non-construction, while tree tree trimming is considered construction). Another factor is the number of employees you have. The State of Florida requirements are different for “non-construction” businesses than they are are for “construction” businesses.

Notice how you pay the employees (e.g. W2 vs 1099) is not a factor. The manner in which you pay an employee does not affect the requirement to carry the coverage because the definition of employee is not affected by how the employee is paid, only if they qualify as an employee by the Florida Statutes.
